Filing an insurance claim can be a stressful process, and understanding the legal timeframe within which an insurer must settle your claim is crucial. In Texas, these timeframes are defined by the Texas Department of Insurance (TDI) and vary depending on the claim type. Here's what you need to know.

Initial Acknowledgment of the Claim

Under Texas law, insurance companies have fifteen calendar days to acknowledge receiving your claim. This time starts on the date they learn of the death. They must not only accept the claim but also ask for any more data or records they require to handle it.

Evaluation and Research

The insurer has 15 business days to go over and assess your claim once it is accepted. This covers looking into the reason for the loss and establishing the veracity of the claim. The insurance company might ask for further paperwork or explanation during this time.

Issuing a Decision

After completing their evaluation, the insurer must accept or deny your claim within the same 15-business-day window. If they decide to deny the claim, they are required to provide you with a written explanation outlining the reasons for their decision.

If additional time is needed, insurers can extend the decision deadline by 45 days. They must notify you in writing about this extension and provide a valid reason for the delay.

Payment Timeline

Once the claim is approved, the insurer has 5 business days to issue the payment. This timeframe ensures prompt compensation for policyholders who have met all the claim requirements.

If the insurer fails to meet these deadlines, they could face penalties or interest payments. You have the right to report such delays to the Texas Department of Insurance.
